What Is Mediation?

What Is Mediation?

Mediation is one of those words people hear during a divorce without really understanding what it means or what actually happens in a mediation.  So let me explain it because once you understand it, you are going to have the information you need to decide if it is an option for you.

Mediation is a process where two parties resolve their issues with the help of a neutral third person called a mediator. In family law and divorce, a mediator at Best Law Firm communicates with both sides and helps them reach agreements on issues they cannot resolve on their own. Nobody decides anything for you. Nobody makes you agree to anything. The mediator guides you through the process, narrows the issues, gives you advice, comes up with creative solutions and helps with the paperwork details. The parties makes the final decisions.  The parties control the outcome.

What to expect

The Smart, Fast & Easy Way To Get A Divorce

Take control of your divorce and make sure you get what you want out of the settlement.

We think your best mediator is an experienced family law attorney who knows the ropes, the law and has seen “it all” so to speak. When we are your mediator, the first thing we do is send you some paperwork so we know about your assets and your family.

How To Choose a Mediator

How To Choose a Mediator

Not all family law mediators are attorneys or licensed in Ariona.  In Arizona there are mediation services operated by non-attorneys or non-Arizona licensed attorneys. Be careful because we have helped clean up some of these mistakes post-divorce. Best Law Firm believes that a licensed Arizona family law attorney is best to help you with  your issues involving spousal maintenance, retirement account division, business valuations, custody arrangements, or the kind of detailed house agreement we described above.  A mediator who does not understand what a judge would actually do with your case in court cannot give either party the realistic picture they need. And a mediator who does not understand the legal details cannot build an agreement that actually holds up when real life happens.

Best Law Firm has four certified attorney mediators. Cynthia L. Best, Esq., Tali Best Collins, Esq., and Megan Spaulding, Esq.  Between us we have been part of more than 5,000 mediations. We know what courts are doing right now. We know what is realistic and what is not. And we know how to build agreements that help prevent future litigation.

We have helped thousands of clients successfully navigate their family law matter.
