Arizona Divorce Checklist: What to Do Before You File

Divorce is not just one legal filing. It includes a packet of documents that can affect your home, finances, parenting schedule, parenting time, retirement, debts, taxes, insurance, spousal maintenance and long-term stability. In Arizona, a divorce is called a dissolution of marriage, and the court requires the final papers to include decisions, agreements, court orders that include legal decision-making, parenting time, child support, spousal maintenance, community property division, and community debt division.

Arizona is also a community property state, which means property and debts acquired during marriage are presumed community to be divided equally. Arizona also recognizes important distinctions about spousal maintenance and domestic violence.
